2.1 This site is operated by MessageLabs Limited. MessageLabs Limited is the data controller for any information collected on this site in accordance with the United Kingdom Data Protection Act.

2.2 Information collected on this site may be transferred to other MessageLabs subsidiaries world wide. These subsidiaries will process this information in accordance with the principles of the EU Directive 95/46/EC of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. MessageLabs Inc in the United States, will process this information in accordance the U.S. Department of Commerce "Safe Harbour" framework.

2.3 In the following MessageLabs Inc, MessageLabs Limited and other MessageLabs subsidiaries will be referred to as MessageLabs.

3 Personal data and purpose

3.1 When you engage in certain activities on this site, such as subscribing to newsletters or down loading software, you will be asked to provide information about yourself by filling out and submitting an online form. It is completely optional for you to engage in these activities. If you elect to engage in these activities, however, MessageLabs may require that you provide personal information, such as your name, mailing address, email address, and other personal identifying information.

3.2 MessageLabs collects this information in order to record and support your participation in the activities you select. For example, if you select to receive newsletters you will need to supply us with your email address. We may also use information collected to provide you with information about MessageLabs products and services.

3.3 This site does not automatically capture or store personal data from visitors to the site, other than to log the user’s IP address and session information such as the duration of the visit to the site and the nature of the browser used. This information is used only for administration of the site system and in the compilation of statistics used by us to assess the use of the site. 3.4 MessageLabs may use web beacons - also known as single pixel or clear GIFs - to analyze traffic patterns such as the frequency of use of particular parts of the site. The data collected helps us learn what information is of most interest to our customers and what offers our customers would most like to see. MessageLabs may also use web beacons in promotional email messages and advertisements to determine whether the message or advertisement was opened and acted on. We may use this information on email response to develop future promotions you may enjoy.

4 Information sharing

4.1 MessageLabs recognises its obligation to use this information in a responsible manner. When we collect information we will indicate which information is necessary in order for you to receive the service requested. Additionally we will indicate which information is “optional”. When you provide information you will be given a preference as to whether you wish to enable MessageLabs to use your information to selectively to provide you with information about other MessageLabs services or products/services of third parties which we think may be of interest to you. If you indicate that you do not want your information to be used for these purposes we will honour your preference.

4.2 MessageLabs may outsource the collection and processing of any MessageLabs information (including but not limited to information collected from this site and from our advertisements) to data processors, agents and service providers. We will do this only for a specific purpose and under a contract which will require the third party to act only on our instructions, to adhere to relevant privacy legislation, to keep the data secure and confidential.

4.3 Except as declared in this policy MessageLabs will not transfer personal data to other entities without consent from the visitor unless MessageLabs is legally required to do so, for example, by a court order or subpoena.

5.1 MessageLabs is not responsible for the content or privacy practices of non MessageLabs web sites to which any MessageLabs web site may link.

6 Changes

6.1 MessageLabs reserves the right to make changes to this policy. If we do we will publish the new policy on this site.

6.2 In accordance with EU data protection legislation and the U.S. safe harbour principles MessageLabs will only use collected data for the purpose it was collected for originally unless we get your consent to use it for a new purpose.

MessageLabs will cooperate fully with the U.S. Department of Commerce, EU data protection authorities, including the United Kingdom Information Commissioner, and other relevant regulatory authorities.
